These Terms and Conditions (“Terms”) govern your use of the website infinumbjj.com and the services provided by Infinum Brazilian Jiu-Jitsu (“we,” “us,” or “our”), located at 125 Sherwood Drive, Unit 34, Brantford, ON N3R 6M7. By accessing or using our website, submitting a form, or engaging with our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Description of Services
Infinum Brazilian Jiu-Jitsu provides Brazilian Jiu-Jitsu instruction for all ages at our academy in Brantford, Ontario, Canada. Our programs include Adult Lessons, Women's Lessons, Youth (10–13) Lessons, and Junior (7–9) Lessons. We also offer free trial classes for new students.
2. Eligibility
Our website is intended for users who are at least 18 years of age. If you are under 18, you may only use this website with the involvement of a parent or legal guardian. Parents or legal guardians must submit enrollment information and provide consent on behalf of minors participating in our youth programs.
3. Free Trial Classes
We offer a free trial class to new students. The free trial is limited to one class per individual. Participation in a free trial class does not create an obligation to enroll or purchase a membership. All participants (or their parent/guardian for minors) may be required to sign a liability waiver before participating in any class.
4. Assumption of Risk and Liability Waiver
Brazilian Jiu-Jitsu is a contact sport that involves physical exertion and risk of injury. By participating in any class, training session, or event at Infinum Brazilian Jiu-Jitsu, you acknowledge and accept the inherent risks associated with martial arts training, including but not limited to sprains, strains, bruises, fractures, and other physical injuries.
All participants (or a parent/guardian on behalf of a minor) are required to sign a waiver and release of liability prior to participation. This waiver releases Infinum Brazilian Jiu-Jitsu, its instructors, staff, and affiliates from liability for injuries sustained during training, except in cases of gross negligence or willful misconduct.
5. SMS / Text Message Terms
By providing your phone number and opting in to receive text messages from Infinum Brazilian Jiu-Jitsu, you agree to the following terms:
- You consent to receive recurring SMS/MMS messages from Infinum Brazilian Jiu-Jitsu, including appointment reminders, class notifications, and promotional messages.
- Message frequency varies. You may receive up to 10 messages per month.
- Message and data rates may apply. Contact your mobile carrier for details about your text messaging plan.
- Text STOP to any message to opt out of receiving future messages. You may also opt out by calling (289) 216-8486 or emailing info@infinumbjj.com.
- Text HELP to any message for assistance, or contact us at (289) 216-8486.
- Consent to receive text messages is not required as a condition of purchasing any goods or services.
- No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.
- We will honor opt-out requests within 10 business days as required by the TCPA and FCC regulations.
- Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and Sprint. Carrier messaging services may not be available in all areas.
- Carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your mobile carrier and is not guaranteed by Infinum Brazilian Jiu-Jitsu.

6. User Communications and Consent
By submitting a form on our website, you consent to being contacted by Infinum Brazilian Jiu-Jitsu via the contact information you provide, including by phone, email, and/or text message, for the purpose of responding to your inquiry. If you opt in to receive marketing communications, you consent to receive promotional messages from us.
In accordance with the FCC's one-to-one consent rule (effective January 27, 2026), your consent to receive communications from Infinum Brazilian Jiu-Jitsu is specific to our business only. We do not obtain consent on behalf of any other company.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or your use of the website shall be resolved in the courts located in Brantford, Ontario, Canada, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
